‍These Terms of Service (“Terms”) govern your access to and use of the game Dreams & Desires™, including all related VR experiences, 360° video content, downloadable content (including the free 8K DLC), updates, and all other interactive services provided by the Company (collectively, the “Game” or “Service”).

By downloading, accessing, installing, or playing the Game on Steam, Meta, or any other supported platform, you agree to be bound by these Terms.

If you do not agree, do not install or use the Game.

The Company is responsible for publishing and operating Dreams & Desires™.

‍2. Age Requirements

‍By accessing or playing the Game, you confirm the following:
• You meet or exceed the minimum age rating required by the platform in your region (typically 12+).
• If your local laws require a higher age for digital consent, data processing, or the purchase/use of digital content, you confirm that you meet those legal requirements.

This may include, for example:
• 13+ in regions subject to COPPA (United States),
• 16+ where required under GDPR (European Union),
• other age thresholds depending on local legislation.

By using the Game, you certify that you are legally permitted to access this type of content in your country or region.

The Company is not responsible for verifying user age and relies on your confirmation of eligibility according to platform rules and applicable laws.

‍3. License Grant

‍The Company grants you a personal, limited, revocable, non-exclusive, non-transferable, non-sublicensable license to:
• Download and install the Game.
• Use the Game on authorized devices.
• Access the free DLC and updates.
• View the included 360° and immersive video content.

You do NOT own the Game or the content inside it.

‍All rights not expressly granted to you are reserved.

‍4. Prohibited Uses

‍You agree NOT to:
• Reverse engineer, decompile, or modify the Game.
• Circumvent DRM or access systems.
• Sell, trade, rent, or transfer the game license.
• Use cheats, hacks, automation tools, or unauthorized software.
• Upload or distribute the Game or DLC outside of Steam or Meta.
• Interfere with servers, analytics, or telemetry systems.
• Violate local laws or the platform’s policies.
• Violation may lead to account restrictions or license termination.

‍5. VR & 360° Video Safety Disclaimer

‍Certain parts of the Game may include virtual reality, 6DoF/3DoF scenes, 360° live-action footage, and high-resolution immersive environments.

By playing, you acknowledge that:
• VR may cause motion sickness, nausea, dizziness, disorientation, or discomfort.
• Stop immediately if you experience symptoms.
• Use VR only in a safe, clear play area.
• Individuals prone to epilepsy, seizures, or vertigo should consult a medical professional before playing.
• You are solely responsible for your physical safety and surroundings.
• Meta and Steam health & safety guidelines apply equally.

The Company is not liable for injuries, accidents, or environmental hazards during VR use.

‍6. 360° Video Content & Real Actors

‍The Game contains professionally filmed live-action scenes with real actors.
‍
All characters, scenes, and storylines are fictional.
‍
Any resemblance to real individuals or organizations is coincidental.

Recording, re-uploading, or redistributing this content is expressly prohibited.

‍7. Free DLC (8K Video Upgrade)

‍The Game includes free optional downloadable content (“DLC”), including but not limited to:
• 8K video enhancement pack.
• Additional cinematic-quality assets.
• Free DLC is treated as part of the Game under these Terms.
• The Company may modify, add, or remove DLC features at any time.

‍8. Updates & Changes to the Game

‍The Company may provide automatic updates, patches, improvements, or changes to:
• Performance, graphics, and 360° video quality
• Story structure and gameplay flow
• VR compatibility
• App stability and UI

You agree that updates may:
• Modify or remove features,
• Change file sizes,
• Adjust performance characteristics.

The Company is not obliged to maintain backward compatibility.

‍9. Platform Accounts

‍Access to the Game requires a valid account on:
‍Steam, orMeta / Oculus

‍Your use of the Game is subject to the platform operator’s Terms, including refund, security, review, and account policies.

The Company does not manage your platform credentials.

‍10. Payment, Purchases & Refunds

10.1 Paid Content
‍Most content in Dreams & Desires is included as part of the base game.
If additional paid features are released in the future, they will follow platform rules.

‍10.2 Refunds
‍Refunds are not handled by the Company.
All purchases, cancellations, and refunds must be requested exclusively through the platform:
‍Steam refund policy (typically within 14 days & < 2 hours played)Meta Store refund policy

The Company must follow platform decisions and cannot override them.

‍10.3 Free Items
‍Items or content distributed free of charge (bonuses, updates, DLC, promotional items) are:
• Not eligible for refunds, and
• May be modified or removed.

11. Ownership & Intellectual Property

‍All rights in:
• The Game,
• 360° and cinematic footage,
• Characters,
• story,
• locations,
• branding,
• UI,
• audio,
• and visual assetsDLC,
• updates,
• and future content,

are owned exclusively by the Company.

You receive a license to use - not to reproduce or exploit.
‍
You may not:
• Redistribute the video content,
• Extract or save raw video files,
• Use footage for any commercial purpose,
• stream or upload copyrighted scenes.

12. Service Availability

‍The Game is provided “as is” and “as available”.
‍
The Company may temporarily or permanently restrict access due to:
• Maintenance
• Platform outages
• Legal obligations
• Technical or operational issues
• Business decisions

If the Company permanently discontinues the Game, users will be notified at least 30 days in advance, subject to platform rules.

‍13. Warranty Disclaimer

‍To the maximum extent permitted by law:
The Game is provided without warranties of any kind
‍
‍The Company does not guarantee:
• Uninterrupted operation
• Error-free performance
• Compatibility with all devicesLoss-free storage of progress or data
• VR comfort or absence of adverse effects

This is required by Steam, Meta & U.S. law.

‍14. Limitation of Liability

‍To the maximum extent permitted by law:
• The Company is not liable for physical injuries during VR use.
• The Company is not liable for motion sickness, dizziness, or discomfort.
• The Company is not liable for loss of data, saves, or progress.
• The Company is not liable for delays, outages, or platform failures.
• The Company is not liable for any indirect or consequential damages.

Your sole remedy is to stop using the Game.

‍15. Termination

‍The Company may suspend or terminate your license if you:
• Violate these Terms,
• Violate platform rules,
• Engage in chargeback fraud,
• Tamper with the Game or DRM.

Termination does not entitle you to compensation or refund.

‍16. Governing Law

‍These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules.

‍17. Arbitration & Class Action Waiver (U.S. Only)

‍You agree that:
• Any dispute with the Company will be resolved through binding arbitration,
• You waive your right to participate in a class action lawsuit.

This protects you from class-action exposure.

‍18. Changes to Terms

‍We may revise these Terms at any time.
If changes are material, we will provide notification at least 30 days prior via Steam, Meta, or our website.
Continued use of the Game constitutes acceptance.
